This End User License Agreement ("Agreement") is a legal agreement between you and Michael Sotnikov ("Author") for the TVirl. IPTV for Android TV application ("Software").
The Software is licensed, not sold, to you. By installing or using the Software, you agree to be bound by the terms and conditions of this Agreement. If you do not agree to the terms of this Agreement, do not install or use the Software.
The Author grants you a personal, non-exclusive, non-transferable, limited license to install and use the Software on your Android TV devices solely in connection with the Software's intended functionality and strictly in accordance with the terms of this Agreement.
You agree not to, and you will not permit others to:
The Author and its licensors retain all right, title, and interest, including all Intellectual Property Rights, in and to the Software, including all related copyrights, trademarks, and other intellectual property rights.
The Software may display, include or make available third-party content (including data, information, applications and other products services) or provide links to third-party websites or services ("Third-Party Services").
You acknowledge and agree that the Author shall not be responsible for any Third-Party Services, including their accuracy, completeness, timeliness, validity, copyright compliance, legality, decency, quality or any other aspect thereof.
The Software may contain Open Source Software components, which are subject to their respective Open Source Licenses. A list of such components and licenses is available in the Software documentation or "Licenses" section within the app.
This Agreement shall remain in effect until terminated by you or the Author. The Author may, in its sole discretion, at any time and for any or no reason, suspend or terminate this Agreement with or without prior notice.
This Agreement and the license granted hereunder will terminate automatically, without notice from the Author, if you fail to comply with any term(s) of this Agreement.
Upon termination of this Agreement, you shall cease all use of the Software and delete all copies of the Software from your devices.
THE SOFTWARE IS PROVIDED TO YOU "AS IS" AND "AS AVAILABLE" AND WITH ALL FAULTS AND DEFECTS WITHOUT WARRANTY OF ANY KIND. To the maximum extent permitted under applicable law, the Author expressly disclaims all warranties, whether express, implied, statutory or otherwise, with respect to the Software.
Notwithstanding any damages that you might incur, the entire liability of the Author and its licensors under any provision of this Agreement and your exclusive remedy for all of the foregoing shall be limited to the maximum extent permitted by law or the amount actually paid by you for the Software.
You shall not use the Software in violation of any applicable export control laws or sanctions. You represent and warrant that (i) you are not located in a country that is subject to a U.S. Government embargo, or that has been designated by the U.S. Government as a "terrorist supporting" country; and (ii) you are not listed on any U.S. Government list of prohibited or restricted parties.
The laws of Belarus, excluding its conflicts of law rules, shall govern this Agreement and your use of the Software. Your use of the Software may also be subject to other local, state, national, or international laws.
Your use of the Software is also governed by our Privacy Policy, which is incorporated into this Agreement by this reference.
